A U. S. federal judge yesterday ordered U. prosecutors to investigate allegations the drug maker had agreed to sell Viagra, a popular treatment for erectile dysfunction, without a doctor's prescription.
The judge ordered U. prosecutors to unseal Viagra evidence and admit to all conduct within six months.
In the same court, the U. Food and Drug Administration also issued a warning to consumers that they should steer clear of the drug, but it was not immediately clear whether it was contained in Viagra or not.
The FDA has said it was aware of reports of illegal marketing of Viagra but declined to disclose their contents.
But U. District Judge Kennethenezuelo also ruled yesterday that the U. government's "safety" experts did not fully understand the risks involved.
The judge ordered prosecutors to make a "defensible and likely risk assessment" of whether to prosecute the maker of the drug and to investigate whether to bring a civil suit.
Prosecutors are expected to meet in San Francisco, on June 17, at 9:00 a.m. and meet at 11:00 a.m. in a case that will also involve the pharmaceutical giant Pfizer Inc.
In the first hearing before U. District Judgeenezuelo, an assistant attorney general also testified in favor of the government.
"It is very important that we don't let the government go to jail and it's very important that the government has a full-time defense," said Attorney General William Tong.
The court said the government has failed to show that the drugmaker had any hidden costs, either to the U. or to other defendants, and that the government would have to find a way to keep Viagra out of the country.
The company was not alone in its attempts to hide its cost.
It is also not clear how many men in the United States are addicted to the drug. A recent report by theNew England Journal of Medicinedid not specify how many Viagra users have suffered from the drug, but suggested it could be as high as 40 million.
In its release, the FDA said the agency noted that the drug had been used for about a decade. The agency said the use of the drug for more than a year was not a factor, but "did not indicate that the use of Viagra did not result in serious health problems."
U. health officials said the drug maker should have made clear that they knew of the risks.
But they did not provide any evidence of how many men in the U. were taking the drug.
The FDA said that the drug had been tested in three other countries, including the United Kingdom and Canada, and that some studies had indicated that the drug caused fewer than 1 million deaths.
The FDA said it was aware of a study that found that the drug increased the risk of heart attacks and strokes. But it did not give a reason for the study.
The FDA also said that its analysis of Viagra sales did not reveal how many people were taking the drug and that it did not reveal why.
But the FDA said it would not comment on the results of the drug study because it was not making any findings on the drug's safety.
The FDA said that it was concerned that the company would take advantage of the public's trust in a drug that had such an impact on a number of men.
"The FDA is making a reasonable safety assessment, and the company has made a reasonable safety assessment of the risks and benefits of Viagra," said FDA official John Smith.
Viagra is used to treat erectile dysfunction and has been approved for such uses as heart problems and high blood pressure. The drug's brand names include Viagra, Cialis, Levitra, and Staxyn.
Viagra also is used for the treatment of pulmonary arterial hypertension. In addition, Viagra has been approved for such uses as treating erectile dysfunction and high blood pressure.
The FDA said that the company had not been told by the government about the safety of Viagra. But it said that the company would not comment on the drug's use for the purposes of any investigation.
The FDA also said that the company had provided the government with copies of the drug's label and that the company would continue to monitor the label for any potential problems with the drug.
